Who these terms are for

Our apps are for Shopify merchants (“you”). You must be able to enter into a binding agreement, and if you install an app for a business, you agree to these terms on its behalf.

Our apps are installed through Shopify, so the Shopify Terms of Service also apply. If they conflict with these terms on anything about Shopify itself, Shopify's terms win.

Using our apps

While these terms are in effect, we give you a non-exclusive, non-transferable right to use our apps with your Shopify store. You agree not to:

• break the law or Shopify's policies through our apps;
• resell, copy, reverse engineer or build a competing product from our apps;
• interfere with or overload our services, or try to access data that isn't yours.

Your store and your customers

You stay responsible for your store, including:

• the products you sell, their prices, discounts, taxes and shipping charges;
• packing and shipping orders, including the recipient orders Giftcrate creates for multi-recipient gifts;
• your relationship with your customers, including refunds and exchanges;
• having a lawful basis and a privacy notice for the customer and recipient data your store collects.

Your data

Your store data and your customers' data belong to you. You let us process it only to provide and support our apps, as described in our privacy policy.

Pricing

Giftcrate is currently free. If we introduce paid plans, prices will be shown before you agree to them and billed through Shopify. We won't charge you for anything you haven't approved, and we'll give you notice before changing what is included for free.

Our property

Our apps, this website, and the CosmoBoost and Giftcrate names and logos belong to CosmoBoost. If you send us feedback or ideas, we may use them to improve our apps without owing you anything.

Changes and availability

We improve our apps often, and may add, change or remove features. We aim to keep the services running at all times but can't promise they'll be uninterrupted, for example during maintenance or outages at Shopify or our hosting providers.

Ending these terms

You can stop using an app at any time by uninstalling it from your Shopify admin; we then delete your data as set out in our privacy policy. We may suspend or end your access if you break these terms or if we stop offering an app, and we'll give reasonable notice where we can.

Disclaimer

Our services are provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, including that the services will be error-free or fit a particular purpose.

Limitation of liability

To the extent the law allows, CosmoBoost isn't liable for indirect or consequential losses, such as lost profits, revenue, sales or data. Our total liability for any claim about the services is limited to the greater of the amount you paid us in the 12 months before the claim and US$100.

Nothing in these terms limits liability that can't be limited by law.

Indemnity

You agree to cover claims brought against us by third parties that arise from your store, your products or your breach of these terms.

Changes to these terms

We may update these terms and will change the date at the top when we do. For significant changes we'll let you know in the app or by email. Continuing to use our apps after a change means you accept the new terms.
